TERMS AND CONDITIONS

These Terms and Conditions (“Terms”) govern reservations, stays, purchases, and use of the website and services of Edelweiss Lodge & Spa (“Edelweiss,” “Lodge,” “we,” “us,” or “our”). By making a reservation, booking or purchasing services, staying at the Lodge, accessing our website, or otherwise using our services, you agree to these Terms.

Please read these Terms carefully before making a reservation.

1. Reservations

Reservations are subject to availability and are not confirmed until Edelweiss provides a reservation confirmation.

The person making a reservation represents that they are authorized to make the reservation and agrees to these Terms on behalf of all guests included in the reservation.

Guests must provide accurate and complete information when making a reservation. Edelweiss reserves the right to cancel or modify a reservation if information provided is materially inaccurate or fraudulent.

The Lodge may require a valid credit card or other payment method to guarantee a reservation.

2. Rates and Charges

Room rates, taxes, fees, and other charges are those disclosed during the reservation process or otherwise communicated by Edelweiss.

Rates may vary depending on dates, room type, availability, occupancy, length of stay, promotions, and other factors.

Unless expressly stated otherwise, quoted rates do not include applicable taxes, fees, or additional charges.

Guests are responsible for all charges associated with their reservation and stay, including applicable room charges, taxes, fees, damage charges, and charges for services or items requested or used during the stay.

3. Payment Authorization

By providing a payment card or other payment method, you authorize Edelweiss and its payment-processing providers to charge the applicable amounts associated with your reservation and stay.

Edelweiss may place an authorization or hold on a payment card for anticipated room charges, taxes, incidental expenses, deposits, or other amounts permitted under the reservation terms.

If a payment is declined or cannot be processed, Edelweiss may require another valid payment method and, where permitted, may cancel the reservation.

4. Cancellation and No-Show Policy

Cancellation policies vary depending on the rate, reservation, season, special event, package, or promotional offer selected.

The cancellation and payment terms applicable to your reservation will be disclosed at the time of booking and are incorporated into these Terms.

Unless a different cancellation policy is expressly stated for your reservation, failure to cancel within the applicable cancellation period may result in a charge for some or all of the reserved stay.

Failure to arrive for a reservation (“no-show”) may result in charges in accordance with the applicable reservation’s cancellation policy.

Certain promotional, prepaid, package, or special-event reservations may be non-refundable or subject to additional restrictions.

5. Check-In and Check-Out

Check-in and check-out times will be provided with your reservation or otherwise communicated by Edelweiss.

Early check-in and late check-out are subject to availability and may be subject to additional charges.

Edelweiss may require government-issued identification and a valid payment method at check-in.

The Lodge reserves the right to refuse check-in when permitted by applicable law, including where a guest cannot satisfy applicable identification, payment, occupancy, or reservation requirements.

6. Occupancy and Guests

Guests must comply with applicable occupancy limits for the reserved room or accommodation.

Only the guests identified in the reservation or otherwise authorized by Edelweiss may occupy a room or accommodation.

Edelweiss may charge additional fees for unauthorized occupants or guests, where permitted by applicable law.

Guests are responsible for the conduct of all members of their party and visitors they bring onto the property.

7. Guest Conduct

Guests are expected to conduct themselves in a manner that respects other guests, employees, the Lodge, and the surrounding property.

The following are prohibited:

  • Excessive noise or disruptive behavior;
  • Threatening, abusive, or harassing conduct;
  • Damage to Lodge property;
  • Unauthorized events or parties;
  • Illegal activity;
  • Interference with Lodge employees performing their duties;
  • Unauthorized smoking or use of tobacco products throughout the Lodge;
  • Any conduct that creates an unreasonable safety, health, or security risk; and
  • Any other conduct prohibited by applicable law or Lodge rules.

Edelweiss may require a guest to leave the property, without refund where permitted by law, if the guest violates these Terms or otherwise engages in conduct that threatens the safety, security, property, employees, or other guests of the Lodge.

8. Smoking and Fire Safety

Smoking, vaping, or use of other products may be prohibited throughout the property and property grounds.

Guests must comply with all posted fire-safety rules and instructions.

The use of candles, open flames, fireworks, or other potentially hazardous items is prohibited except where expressly authorized by Edelweiss and permitted by law.

Guests may be responsible for reasonable cleaning, restoration, repair, or other charges resulting from smoking or other prohibited activities.

9. Damage to Property

Guests are responsible for damage to the Lodge, its furnishings, equipment, fixtures, or other property caused by the guest or members of the guest’s party, except to the extent caused by ordinary wear and tear or the negligence or willful misconduct of Edelweiss.

Edelweiss may charge the guest’s payment method for reasonable costs associated with repairing or replacing damaged property.

Guests must not remove Lodge property from guest rooms or other areas of the property without authorization.

10. Personal Belongings

Guests are responsible for their personal belongings.

Edelweiss is not responsible for lost, stolen, or damaged personal property except to the extent liability cannot lawfully be disclaimed or is caused by Edelweiss’s negligence, willful misconduct, or other conduct for which Edelweiss is legally responsible.

Guests should not leave valuable items unattended.

If you discover that you have left an item at the Lodge, contact us promptly. We will make reasonable efforts to locate and return property that has been found, subject to applicable law and our policies.

11. Amenities and Services

Amenities, facilities, activities, services, and operating hours may vary and may be changed, limited, suspended, or discontinued without notice due to weather, maintenance, safety concerns, availability, staffing, operational considerations, or circumstances beyond our reasonable control.

Some amenities or services may require advance reservations, additional charges, or compliance with additional rules.

12. Weather and Mountain Conditions

Edelweiss is located in a mountain environment where weather, road conditions, snow conditions, and other natural conditions may change rapidly.

Guests are responsible for making appropriate travel arrangements and exercising reasonable caution based on current conditions.

Closures, delays, cancellations, or changes resulting from weather, transportation conditions, governmental orders, natural events, or other circumstances beyond the reasonable control of Edelweiss do not necessarily entitle a guest to a refund or other compensation, except where required by applicable law or expressly provided under the applicable reservation terms.

13. Activities and Assumption of Risk

Certain activities and conditions associated with mountain lodging may involve inherent risks, including but not limited to snow, ice, uneven terrain, elevation, wildlife, outdoor activities, recreational activities, and changing weather conditions.

Guests are responsible for exercising appropriate care and following applicable safety instructions, posted warnings, and instructions from Lodge personnel and activity providers.

Nothing in these Terms is intended to waive or limit any right, claim, or liability that cannot lawfully be waived or limited under applicable law.

14. Website Use

Our website is provided for informational and reservation purposes.

You agree not to:

  • Use the website for unlawful purposes;
  • Attempt to gain unauthorized access to our systems;
  • Interfere with the operation or security of the website;
  • Introduce malicious code or harmful software;
  • Use automated systems to improperly access or collect information from the website; or
  • Misrepresent your identity or affiliation.

We attempt to maintain accurate information on our website but do not warrant that all information is complete, current, or error-free.

15. Text Messages and SMS Communications

If you provide a mobile telephone number and consent to receive SMS/text messages from Edelweiss, you agree that we may send text messages concerning your reservation, stay, inquiries, guest services, and, where separately authorized, promotional or marketing communications.

Message frequency may vary. Message frequency based on reservations and customer needs and interaction. Message and data rates may apply.  Carriers are not liable for any delayed or undelivered messages

You may opt out of marketing text messages at any time by replying STOP. For assistance, reply HELP or contact Edelweiss using the contact information below.

Your consent to receive marketing text messages is not a condition of purchasing lodging or services.

Opting out of marketing communications will not necessarily prevent us from sending transactional or service-related communications that are reasonably necessary to administer an existing reservation or provide services you have requested, to the extent permitted by applicable law.

16. Privacy

Your use of our website and services is also subject to our Privacy Policy, which describes how we collect, use, disclose, and protect personal information.

The Privacy Policy is incorporated into these Terms by reference.

17. Third-Party Services

Edelweiss may use third-party providers for reservations, payment processing, communications, transportation, activities, website services, and other functions.

Third-party services may be subject to additional terms and conditions established by the applicable provider.

Edelweiss is not responsible for the acts or omissions of independent third-party providers except to the extent provided by applicable law.

18. Force Majeure

Edelweiss will not be responsible for failure, delay, interruption, or inability to provide accommodations or services caused by circumstances beyond our reasonable control, including severe weather, natural disasters, fire, utility failures, governmental actions, public emergencies, labor disruptions, transportation disruptions, acts of terrorism, civil disturbances, or other events beyond our reasonable control.

Nothing in this provision limits rights or remedies that cannot legally be limited.

19. Limitation of Liability

To the maximum extent permitted by applicable law, Edelweiss will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or relating to a reservation, stay, website use, or use of Lodge services.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law, including liability resulting from fraud, willful misconduct, or other conduct for which liability cannot lawfully be waived.

20. Indemnification

To the extent permitted by applicable law, guests agree to be responsible for losses, damages, claims, liabilities, costs, and reasonable expenses arising from their violation of these Terms, violation of applicable law, or damage caused by the guest or members of the guest’s party.

21. Disputes and Governing Law

These Terms will be governed by the laws of the State of New Mexico, without regard to conflict-of-law principles, except to the extent federal law or applicable law requires otherwise.

Any dispute arising from or relating to these Terms, a reservation, or a stay at Edelweiss shall be brought in a court of competent jurisdiction in New Mexico, unless applicable law requires a different forum.

Nothing in this section prevents a guest from exercising rights that cannot lawfully be waived.

22. Changes to These Terms

Edelweiss may modify these Terms from time to time. Updated Terms will be posted on our website with a revised Effective Date.

Changes will apply prospectively unless otherwise required by law. The Terms in effect at the time a reservation is made will generally govern that reservation, subject to any reservation-specific terms communicated to the guest.

23. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.

24. Entire Agreement

These Terms, together with the applicable reservation terms, rate restrictions, cancellation policy, Privacy Policy, and any other written terms expressly incorporated into the reservation, constitute the agreement between the guest and Edelweiss concerning the applicable reservation and stay.

If there is a conflict between these Terms and a specific reservation confirmation or rate-specific term, the specific reservation term will control to the extent of the conflict.
